In this presentation, Professor Wagner reviews the competing approaches to interpreting the Constitution. He then analyzes the impact of each approach on governance and the rule of law. With powerful examples he shows how originalism approaches lead to politically accountable good governance under the rule of law, while organic approaches lead to non-politically accountable judicial tyranny.
